Partnership Conditions and Legal Relationships

The JOCHS process begins with the development of a partnership between public health, public safety and community health clinics. Each jurisdiction configures a unique partnership, but most will include local departments of mental and public health, probation, and education plus community health centers and other community-based youth-serving agencies. A crucial step to establishing connectivity for youth brought to detention and community health services will be an evaluation of the feasibility of federally qualified health center (FQHC) participation and a subsequent negotiation of terms and conditions.

COCHS obtained assistance from legal counsel to develop a manual describing the various legal relationships possible between health care centers and local correctional facilities. The issues for health centers apply equally to adult and juvenile facilities. JOCHS recommends a review of this manual before undertaking the following implementation task list.

Implementation Task List

When a local jurisdiction makes the decision to partner with a local community health clinic to provide care in its juvenile detention facility clinic, there is a series of implementation tasks that must be undertaken by the agencies involved. JOCHS has created a basic list of tasks that is fairly comprehensive and will apply to most partnerships. A thorough review of pertinent state and federal standards and regulations and best practices for health care in juvenile detention will guide the implementation process.
